The standard personal auto policy that Nevada's Division of Insurance (NV DOI) publishes is the ISO form PP 00 01. ISO is the group that writes standard policy forms for insurers. That form calls a rental a "non-owned auto." For damage to one, it gives you the broadest cover you carry on any car on your policy.

Liability works the same way. Liability pays for injuries and damage you cause to other people. The form covers you for "use of any auto," so your limits go with you into the rental. Nevada's legal minimum is $25,000 per person, $50,000 per crash for injuries, and $20,000 for property damage, under NRS 485.185.

What does Nevada law say about the rental damage waiver?

Nevada law says a rental company cannot force you to buy its damage waiver, and it caps the price. These rules generally apply statewide, so they work the same whether you rent in Henderson or at the Las Vegas airport. A damage waiver is the rental company's promise not to bill you for damage to its car. It is not an insurance policy.

The rules sit in NRS 482.3151 to 482.3159, the part of Nevada law for short-term car rentals. Four of them matter most to a Henderson driver.

In plain words, the law requires the rental company to tell you your own insurance may already cover you. The sign must also tell you to ask your insurer (the company that issued your policy) before you decide.

Should you buy the rental company's damage waiver?

Whether to buy the damage waiver depends mostly on whether your own policy carries collision and comprehensive. Some drivers who carry liability only choose to buy the waiver, because without it a crash or theft can leave the repair bill with them. Others who carry collision and comprehensive, with a deductible they can pay, decide to skip it.

Read the rental agreement first. Nevada law makes a waiver cover damage and loss of use. The rental company can only leave out cases the law lists, such as reckless driving or a driver not named on the contract. These four questions can help you think it through. This is general information, not advice on what to buy.

  1. No collision or comprehensive on your own car? The waiver may be worth pricing. Without it, a crash or theft can leave the repair bill with you.
  2. Renting for work? Check first. Triple-I, the Insurance Information Institute, says your own cover usually applies when the rental is for recreation, not for business.
  3. Collision and comprehensive, with a deductible you can pay? The waiver is optional. It mainly trades a daily price for your deductible and the rental company's fees, subject to its terms.
  4. A high deductible, like $1,000 or more? Compare the waiver's total price for the trip to that deductible plus the fees in the next section.

Triple-I also notes a waiver can be voided for things like driving on unpaved roads or driving while drunk. Nevada law lists similar exceptions. Read the lease before you sign it.

What can a Nevada rental company charge you after a crash?

For crash damage, a Nevada rental company can charge you for repairs, lost rental days, towing and a capped paperwork fee. NRS 482.3154 sets the ceiling.

Here is how that adds up, on a made-up Henderson fender bender. It is illustrative only, not a quote and not a determination of coverage.

Case A: a 4 day rental at a made-up $50 a day. You back into a pole. The repair estimate is $1,800, with 16 hours to replace and repair the parts. Your collision deductible is $500. Assumes payment starts on day one; your carrier's form may start payment after a waiting period. All figures are illustrative.

The math is short. Sixteen hours to replace and repair, divided by 8, is 2 days, and 2 times $50 is $100 of loss of use. Add $1,800 of repairs and the $150 fee for $2,050 in total.

Your collision pays $1,800 minus the $500 deductible, which is $1,300. The basic ISO form pays loss of use at up to $20 a day, so $40. That leaves you $710. For comparison, a waiver at a made-up $30 a day for 4 days would have cost $120. Under Nevada law, a waiver covers damage and loss of use. The exceptions are cases the law lists, such as a driver not named on the contract.

Two more Nevada rules help you after a crash. A rental company may not put a hold on your credit card for damage. It also needs your written consent, on a separate form, before it charges your card for repairs. That is NRS 482.3157.

Who pays for a rental while your car is in the shop?

Your own policy pays for a rental while your car is fixed only if it carries rental coverage, and the daily limit is often small. That coverage is called transportation expense or rental reimbursement. Rental reimbursement is optional coverage that pays toward a rental car after a covered loss.

The basic ISO form has a small version built in. It applies when your car has collision or comprehensive for that kind of loss.

Temporary transportation expenses not exceeding $20 per day incurred by you in the event of a loss to "your covered auto".

That same section caps the total at $600, with no deductible. After a theft, payments start 48 hours after the car is taken. For other losses, they start once the car has been out of use for more than 24 hours. Payments last only as long as the repair reasonably takes.

Your own carrier (the insurance company on your policy) may use a newer form with different numbers. Look on your declarations page (the summary page of your policy) for a line called rental reimbursement or transportation expense.

Case B: your car spends 12 days in a Henderson body shop after a covered crash. The rental costs a made-up $45 a day, or $540 in total. Assumes payment starts on day one; your carrier's form may start payment after a waiting period. Illustrative only, not a quote.

The math: 12 days times $45 is $540. At $20 a day the policy pays $240, which is under the $600 cap, so you pay $300. At $40 a day it pays $480 and you pay $60. The $40 option is a sample for the arithmetic, not a price or a product any carrier must offer.

If another driver caused the crash, you can also claim against their liability insurance. The standard form defines property damage to include "loss of use," so a reasonable rental can be part of that claim. But the other insurer may take time to accept fault. How much rental reimbursement should a Henderson driver carry?

Carry a daily rental limit close to what a basic rental costs you, for at least two to four weeks of repairs. A daily limit is the most the policy pays for one day of rental.

Use three numbers to set it.

Multiply the daily price by the days. Compare that with the total limit on your policy. The gap is what you would pay yourself.

Rental reimbursement adds to your premium, the price you pay for the policy. When does your own policy not cover a rental car?

Your own policy may not cover a rental car when you use it for work, drive it for pay, or carry no collision or comprehensive. Check these five gaps before you rent.

Theft has its own Nevada rule. If the rental is stolen, you are presumed to owe nothing for the theft. That applies if you still have the key the company gave you, or can show it was not in the car. The company can try to prove otherwise. You must also report the theft to police within 24 hours of learning of it, and help with the case. In Henderson, that means the Henderson Police Department.

Does a credit card cover a rental car?

A credit card may give some rental car cover, but it is usually limited and usually pays only after your own insurance. Triple-I says card benefits are usually "secondary," so they start after your personal policy.

Card benefits also differ by bank and by card level. Some cards may only cover your deductible. Ask the bank to send the rental car benefit to you in writing before you rely on it.

Before your next rental, open your declarations page and find three lines: collision, comprehensive and rental reimbursement. If the first two are there, the counter waiver is a choice, not a must. If the third reads $20 a day, price a higher limit before you need it. In Case A, the made-up $120 waiver costs less than the $500 deductible alone. Nevada law requires it to cover the damage unless a listed exception applies, such as reckless driving.
